1. Who we are

SOMMOS is operated by DIEGO NADER MACHUCA, a sole proprietor
registered in Mexico.

By placing an order on this website you agree to these terms.

2. What you are buying

You are buying an original, one-of-a-kind physical artwork on paper,
drawn by a pen plotter, made to order. Each piece is accompanied by a
printed interpretive text.

The price is USD $249 per piece. That price includes the artwork, the
printed text, worldwide shipping, and all duties, tariffs and import
fees. You will never be asked for an additional payment on delivery.

3. You must be 18 or older

This website and its products are intended for adults. By placing an
order you confirm that you are 18 years of age or older.

4. Information you provide

To make your piece we need your date, time and place of birth. You are
responsible for the accuracy of that information. Because each piece is
generated from the data you provide, we cannot remake a piece at no
charge once production has begun due to information entered
incorrectly. See our Returns & Refunds policy.

5. Intellectual property

The algorithms, generative systems, visual language, brand and written
interpretive texts that SOMMOS produces are the intellectual property
of SOMMOS. Each interpretive text is written, edited and approved by a
human author before it is printed.

You own the physical artwork you purchase. You may keep it, display it,
photograph it, gift it, or resell the physical object. You may not
reproduce, print, manufacture or commercially distribute copies of the
artwork or the interpretive text.

6. About your reading

Your SOMMOS piece and the reading that accompanies it are works of art
and interpretation, offered for entertainment and reflective purposes
only. See "About your reading" below, which forms part of these terms.

7. Limitation of liability

To the fullest extent permitted by law, our total liability to you for
any claim arising from your order is limited to the amount you paid for
that order. We are not liable for indirect, incidental or consequential
damages.

Nothing in these terms limits any liability that cannot be limited
under applicable law.

8. Disputes

We would much rather solve a problem directly. Before starting any formal proceeding, please email us at info@sommosart.com and give us 30 days to make it right. Most things end there.

If we cannot resolve it, any dispute arising from your purchase will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Arbitration will be conducted remotely, by videoconference or on the documents, so you never need to travel.

You and SOMMOS each waive the right to participate in a class action or class arbitration.

Exception: either of us may bring an individual claim in small claims court instead of arbitration.

Opting out: you may opt out of this arbitration agreement by emailing info@sommosart.com within 30 days of your first order. Opting out does not affect any other part of these terms.

These terms are governed by the laws of Mexico, without regard to its conflict of law rules. Nothing in this section removes any right you have under the consumer protection laws of the state where you live.

9. Changes

We may update these terms. The version in force is the one published on
this page at the time of your order.
